LESSER-INCLUDED OFFENSES In his next issue, the Defendant contends that the trial court erred by failing to charge the jury on certain lesser-included offenses. Specifically, he states that the trial court erroneously failed to charge the jury on the crime of criminal trespass as a lesser-included offense of aggravated burglary, and on the crime of Class E felony evading arrest as a lesser-included offense of Class D felony evading arrest. The State concedes that both of these offenses are "lesser-includeds, " but argues that the Defendant is not entitled to relief on the trial court's failure to charge them to the jury. The question of whether a given offense should be submitted to the jury as a lesser-included offense is a mixed question of law and fact. See State v. Rush, 50 S.W.3d 424, 427 Tenn. 2001 ; . Our standard of review for mixed questions of law and fact is de novo with no presumption of correctness. See id. Analysis To be successful in his claim for post-conviction relief, the petitioner must prove all factual allegations contained in his post-conviction petition by clear and convincing evidence. "`Clear and convincing evidence means evidence in which there is no serious or substantial doubt about the correctness of the conclusions drawn from the evidence.'" State v. Holder, 15 S.W.3d 905, 911 Tenn. Crim. App. 1999 ; quoting Hodges v. S.C. Toof & Co., 833 S.W.2d 896, 901 n.2 Tenn. 1992 . Issues regarding the credibility of witnesses, the weight and value to be accorded their testimony, and the factual questions raised by the evidence adduced at trial are to be resolved by the post-conviction court as the trier of fact.
